Section 2
Establishment and Arrangement of the Council
2.1 Establishment of the Council: The Ayurveda Medical Council has been established to develop the method of production and use of Ayurvedic medicine and to register the names of doctors to operate the Ayurvedic medical system smoothly. 2.2 The Council shall be a self-governing body: 2.2.1 The Council shall be a self-governing and organized body with unbroken succession. 2.2.2 The Council shall have a separate seal for all business proceedings. 2.2.3 The council may acquire, use, sell or otherwise dispose of movable and immovable property such as persons. 2.2.4 The Council may file a complaint against the same person and the Council may also file a complaint against the Council in the same name. 2.3 Formation of the Council: 2.3.1 The following members will be in the council established according to section 2.1:- 2.3.1.1 Physician nominated by the Government of Nepal - Chairman 2.3.1.2 Physicians nominated by the Government of Nepal from among the physicians Three members - members 2.3.1.3 Director, Department of Ayurveda - members 2.3.1.4 Doctors elected from among themselves as prescribed by registered doctors Three members - members 2.3.1.5 Principals nominated by the Government of Nepal from among the principals of the Ayurveda campus One - Member 2.3.2 If the Government of Nepal deems it necessary, after consulting the Council, it may publish a notice in the Nepal Gazette and change or change the members of the Council. 2.3.2A When nominating the members according to sub-section 2.3.1.2, it should be done from among the qualified doctors as per sub-section 4.2.1.1, 4.2.1.2 and 4.2.1.3. 2.3.2B The Government of Nepal will nominate three members from among the doctors until the members as per sub-section 2.3.1.4 are elected. 2.3.2C According to sub-section 2.3.1.5, when nominating members from among the principals, it should be done from among the registered doctors. 2.3.3 If the Council deems it necessary, it may invite any official of the Government of Nepal or any other expert to attend the meeting of the Council as an observer. 2.3.4 The term of office of the council members will be four years. They are re-nominated after the term endsor may be elected. 2.3.5 If a member's position becomes vacant before the term of office expires, another member will be nominated or elected for the remaining term. 2.3.6 ……………….. 2.4 Tasks, Duties, and Powers of the Council: 2.4.1 The Tasks, Duties, and Powers of the Council shall be as follows:- 2.4.1.1 Diseases from Ayurveda Medical System Strengthening the treatment system and making the necessary arrangements for the smooth operation of Ayurveda medicine. 2.4.1.2 Making necessary arrangements to develop the method of using Ayurvedic medicines. 2.4.1.3 Determine the qualifications of doctors and make arrangements to register the names of doctors who have qualified. 2.4.1.4 Advising the Government of Nepal regarding the production, sale and distribution of Ayurvedic medicines. 2.4.1.5 Suggesting the Nepal government to make necessary arrangements regarding Ayurveda research. 2.4.1.6 To give suggestions to related bodies regarding the level of Ayurveda education. 2.4.1.7 Conducting studies, teaching and training in Ayurveda related subjects, giving recognition to educational institutions established in Nepal and other institutions established for the same purpose as prescribed. 2.4.1.8 Evaluating and reviewing the curriculum, admission conditions and examination system related policies and other necessary minimum infrastructure of the educational institutions established in Nep and other institutions established for such purpose to provide study, teaching and training in Ayurveda related subjects. to do 2.4.1.9 To recognize the academic qualifications and degrees provided in Ayurveda and modern medicine and surgery and medical assistant subjects as prescribed. 2.4.1.10 Determining policies necessary for the smooth operation of Ayurveda medical business. 2.4.1.11 To prepare a prescribed code of conduct for doctors and to remove the name from the register by taking action against the doctor who violates such code of conduct. 2.5 Disqualification as a member: 2.5.1 Any of the following persons shall be elected, nominated orThe following shall be considered ineligible to continue in office:- 2.5.1.1 whose name has been removed from the registration book, 2.5.1.2 non-Nepali citizens, 2.5.1.3 falling into Damasahi due to non-payment of money-lenders, 2.5.1.4 Having been found guilty by a court of law on a criminal charge of moral turpitude, or 2.5.1.5. 2.6 Termination of Membership: 2.6.1 Membership of the Council shall be deemed terminated in the following cases:- 2.6.1.1 In case of ineligibility to remain a member as per section 2.5, 2.6.1.2 Resignation from the position of a member. If approved, 2.6.1.3 Death, or 2.6.1.4 Absence from more than three consecutive meetings of the Council without notifying the Council with reasons. 2.7 Council meetings and decisions: 2.7.1. The meeting of the council will be held as determined by the chairman. 2.7.2 The meeting of the Council shall normally be held three times a year and the Chairman may convene more meetings if deemed necessary. 2.7.3 The meeting of the Council shall be presided over by the Chairman and in his absence a person chosen by the members from among themselves shall preside over the meeting. 2.7.4 If fifty percent of the total number of members of the Council are present, the quorum for the meeting of the Council shall be considered. 2.7.5 The opinion of the majority in the meeting of the Council shall be valid and in case of equality of votes, the person presiding over the meeting shall have the casting vote. 2.7.6 The decision of the Council shall be verified by the Registrar. 2.7.7 Allowances and other facilities that the members will receive while participating in the meeting will be as specified. 2.7.8 Other procedures to be adopted in the meeting of the Council may be determined by the Council itself. 2.8 Delegation of Powers: The Council may delegate its powers to the chairman, members or the committee or sub-committee of the members as specified. 2.9 Actions shall not be invalidated: If it is discovered later that any provision under this Act has not been followed in relation to the appointment of a member, the actions taken by such a member before such discovery shall not be invalidated by that fact alone.
